These terms and conditions are published by Jakobsen Atelier s.r.o., with its registered office at Stavební 169/1, 602 00 Brno, Czech Republic, and identification number: 05699738 (hereinafter referred to as the “seller”). These terms and conditions apply to the site and all products and services offered by the seller.

In accordance with the General Data Protection Regulation (GDPR), by using this site, you consent to the processing of your personal data by the seller for the purpose of fulfilling the contract.

The mutual rights and obligations of the seller and the customer not specified in these terms and conditions are governed by Czech law. If the customer and the seller conclude a sales contract or service agreement that cannot be settled by mutual agreement, the customer may submit a proposal for an out-of-court settlement to an Alternative Dispute Resolution (ADR) entity, which is:

Products

The customer may purchase any product presented as available and at the price indicated on the site at the time of placing the order. If, despite our vigilance, the products are unavailable, the seller will inform the customer by e-mail as soon as possible and offer an appropriate solution.

The product descriptions summarize their aesthetic and technical characteristics. The photos of products placed online on the site are as faithful as possible to reality. However, the customer understands and accepts that certain products are created or made using processes which do not enable to obtain products which are all exactly identical but which gives each one their own identity and look, which may vary significantly from one product to another and differ slightly from the photos placed online on the site.

Registration on the site

In order to place an order on the site, each customer must create an account by completing the registration process and providing the required information.

The accuracy of the personal data provided by the customer is the customer’s sole responsibility. The seller will not verify the accuracy of this information and cannot be held liable if incorrect details hinder the proper execution of an order or delivery.

Upon creating his account, the customer selects a unique login and password to identify himself on the site. He is solely responsible for keeping this information confidential. With these credentials, the customer can access his account at any time (except during temporary site maintenance) to place orders, track ongoing orders or deliveries, or manage his personal information.

Placing the order

The customer can place orders on the site once he has entered his credentials. He may add any products marked as available to his shopping cart by using the corresponding button, as indicated on the site.

The shopping basket remains available and can be modified until the definitive validation of his purchase order by the customer (hereinafter the “order”).

Once the content of his shopping cart is validated, the customer can confirm his order by completing the following steps:

Confirm the products and the quantities selected;

Complete all the information requested by the site;

Accept without reservation the general terms and conditions of sale, by clicking on the button indicated;

Validate the payment, by clicking on the button indicated.

The validation of the order by the customer’s “click” constitutes acceptance of the prices and characteristics of the products purchased on the site, as well as of these terms and conditions.

The customer is fully responsible for the accuracy of the identification and delivery information provided when placing an order on the site. In the event of an error that causes a delay in delivery, the seller cannot be held liable, and any additional costs will be borne by the customer. If the customer refuses to accept the goods from a valid order confirmed by the seller for reasons other than legal ones, the seller is entitled to seek compensation for any damage incurred, in particular the costs of sending the shipment in vain and returning it to the seller, handling fee, but also a storage fee up to the value of the goods.

Calculation of the total price of the order

Product prices are listed on the site in Euros, US Dollars, and/or Czech Koruna, including a 21% VAT. The prices applied are those shown on the site at the time the customer confirms the order. Preparation and delivery costs are provided to the customer when placing the order and are adjusted based on the delivery location and address. These costs are borne by the customer and are invoiced in addition to the product sale price.

Business customers and non-EU customers

The exception applies to business customers and non-EU customers, who may have part of the delivery costs included in the total product price, depending on the total volume and delivery address. In such cases, product prices are determined and agreed upon individually through mutual agreement between the seller and the customer.

Delivery period

The seller will make its best effort to ensure that the order is shipped within five (5) to fifteen (15) business days from the receipt of the customer’s payment. In any case, all products purchased on the site will be shipped to the address provided by the customer at the time of order, within a maximum of thirty (30) calendar days from the receipt of payment.

Warranty and claims

The warranty period begins on the date the customer receives the goods and lasts for 24 months. If the customer finds a defect in the purchased goods during this period, and the defect is not caused by improper use, the customer has the right to claim the goods.

The subtle imperfections, such as bubbles or slight irregularities, are hallmarks of the human touch and only enhance the beauty and functionality of the product. They are not considered defects.

Customer’s right of withdrawal from the purchase contract

The customer is entitled to withdraw from the contract within 14 days of receiving the goods. However, this right does not apply to business customers and non-EU customers.

Changes to these terms and conditions

The seller reserves the right to update these terms and conditions at any time. You acknowledge and agree that it is your responsibility to periodically review these terms and conditions and stay informed of any modifications.

Your acceptance of these terms

By using this site, you agree to these terms. If you do not agree, please refrain from using our site. Your continued use of the site after any changes to these terms will be deemed your acceptance of those changes.
